MACLEAN’S – TAKE A CLOSER LOOK PHOTO CONTEST

Contest Rules

  1. ELIGIBILITY
    NO PURCHASE NECESSARY. This contest (“Contest”) is open to Canadian residents who have reached the age of majority in their province or territory of residence as of the date of entry. Employees, agents and representatives of the Contest Sponsors or of their subsidiaries, their advertising and promotional agencies or suppliers of prizes, products, services and material related to this Contest, as well as members of their immediate family (brothers, sisters, children, father, mother), their legal or common-law spouse and any individuals with whom such employees, agents and representatives are domiciled, are not eligible. Professional Photographers are not eligible for this contest, only amateur photographers. There is a limit of one (1) submission (“Entry”) per person which must be a submission for the entrant themselves. Entrants must be available to travel to Toronto, Ontario on December 1, 2013 for the Reveal Show on Breakfast Television on December 2, 2013.
  2. CONTEST SPONSOR
    The “TAKE A CLOSER LOOK” Contest is sponsored by Rogers Publishing Limited, publisher of Maclean’s magazine ("Rogers" or “Maclean’s”) and Rogers Broadcasting Limited (“Breakfast Television), (hereinafter collectively called the "Contest Sponsors").
  3. CONTEST PERIOD
    The Contest begins at 5:30:00am ET October 21, 2013 and ends at 11:59:59pm ET December 1, 2013 (the “Contest Period”). There are three (3) phases to this Contest: the submission phase from 5:30:00am ET October 21, 2013 to 11:59:59 p.m. ET on November 24, 2013 (the “Submission Phase”); a top 3 selection phase from 12:00:00 a.m. on November 24, 2013 to 11:59:59 p.m. ET on December 1, 2013 (the “Selection Phase”): and a reveal phase on December 2, 2013 where the Grand Prize winner is revealed, live on Breakfast Television Toronto (the “Reveal Phase”).
  4. ENTRY - SUBMISSION PHASE.
    Internet access required. For a chance to be chosen as a top 3 Finalist, visit the Contest website at www.takeacloserlook.macleans.ca (the “Website”) during the Submission Period. Complete the registration form as indicated and follow the instructions to access and submit your entry including a photo upload of a photo you have taken of a Canadian place, person, moment, landmark from an unexpected point of view showcasing your unique perspective (the “Photo”). The Photo submitted must be sent as a JPEG or GIF file not exceeding 5 Mb. You must then confirm that you are eligible to enter the Contest and that you accept the Contest rules. Click on “Send your submission” to send your entry form no later than the end of the Submission Period. Upon receipt of a confirmation message, you will then automatically be entered in the Contest. To participate in the Contest, you must not refuse “cookies”. Use of automated devices is prohibited; automated entries (including but not limited to entries submitted using any robot, script, macro, or other automated service) are not permitted and may result in disqualification. All Photos will be posted to the Website.

    As a condition of entry, entrants warrant and represent that the Photo:

    1. is original to him/her and that the entrant has all necessary rights in and to the Photo to enter the Contest;
    2. does not violate any law, statute, ordinance or regulation;
    3. does not contain any reference to or likeness of any identifiable third parties;
    4. will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims for payment whatsoever; and is not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following:
      1. Nudity;
      2. Explicit, graphic or excessive sexual activity;
      3. Crude, vulgar or offensive language and/or symbols;
      4. Derogatory characterizations of any ethnic, racial, sexual or religious groups;
      5. Content that endorses, condones and/or discusses any illegal, inappropriate or high risk activity, behaviour or conduct;
      6. Personal information of individuals, including, without limitation, names and addresses (physical or electronic);
      7. Conduct or other activities in violation of these Contest Rules;
      8. Commercial messages, comparisons or solicitations for products or services;
      9. Any identifiable third party products and/or trade-marks, brands or logos. For example, any clothing worn by you in your Photo must not contain any visible logos, trade-marks or other third party materials; and
      10. Any other content that is or could be considered inappropriate, unsuitable or offensive;

    all as determined by the Contest Sponsors in their sole discretion.

    By entering the Contest entrants confirm that he/she owns all intellectual property rights in the Photo, including copyright, publication and duplication rights, grants the Contest Sponsors a worldwide, perpetual, royalty-free license to reproduce and to distribute the Photo in any form or format, and confirms that he/she waives all moral rights in respect of the Photo. Entrants release the Contest Sponsors from any claims arising from the distribution of the Photo on the Website and/or in any other form of medium now or hereafter created and, if requested, supply any additional documentation proving that he/she holds all rights related to the Photo submitted without any form of compensation. A statement to such effect will be included in the Declaration Form;. All Photos and entries submitted become the property of the Contest Sponsors, who reserve the right to refuse any submission or entry.

    By entering this Contest, entrants consent to the use of their entry, name, city of residence and Photo or any photograph of entrant that may be taken in publicity carried out by the Contest Sponsor and/or its advertising agencies, without further notice or compensation.

  5. SELECTION PHASE. During the Selection Phase all entries will be reviewed by a panel (the “Judging Panel”) consisting of representatives of the Contest Sponsors. All entries will be judged and selected based on the following Judging Criteria:
    1. PHOTO SUBMITTED
      Entrants must showcase a unique perspective on Canadian life. Photo should encapsulate a sense of originality and creativity. (100%).

    Each Entry will receive a score, expressed in the number of points out of a maximum possible of 100, based on the Judging Criteria. The three (3) Entries with the highest score as determined by the most points awarded based on the Judging Criteria, in the sole discretion of the Judging Panel, will be the finalists (the “Finalists”) whose entries will move forward to the Reveal Phase. The Contest Sponsors reserve the right to request a potential Finalist to provide any additional document confirming that he/she is the person who took the Photo. The potential Finalist will have to provide such document within 48 hours of the request being made, otherwise the Contest Sponsors reserve the right to disqualify the potential Finalist and withdraw the Photo from the Website. Finalists will receive an email letting them know that their Entry has been selected as a Finalist.

    In the course of determining the Finalists, if two or more Entries finish with the identical score, a random draw will be held from among the tied Entries. The first Entry selected will be deemed to have the higher score from among the tied Entries, and this process will be similarly repeated until all ties have been broken.

  6. REVEAL PHASE. During the Reveal Phase, the three (3) Finalists will be required to appear on Breakfast Television Toronto on the morning of December 2, 2013 where the Grand Prize Winner will be selected. The Secondary Prize will be given to the 2nd place winner and the Tertiary Prize will be given to the 3rd place winner. Each Finalist will select a number from a secure bag. The secure bag will contain the number 1, 2 and 3. The Finalist who picked number 1 will be the selected Finalist for the Grand Prize, the Finalist who picked number 2 will be the selected Finalist for the Secondary Prize and the Finalist who picked number 3 will the selected Finalist for the Tertiary Prize.

    The Breakfast Television Reveal Segment will take place in Toronto, Ontario on December 2, 2013. Each Finalist will receive hotel accommodation for the night of December 1, 2013 based on one room, single occupancy, and transportation to and from Breakfast Television Toronto and hotel. If winner Finalist resides within 300 kms of Toronto, the Finalist will be responsible for their own transportation to and from his/her place of residence to Toronto. In the event that a Finalist resides more than 300 kms from Toronto, return transportation for the Finalist will be provided in addition to the hotel accommodation and transportation to and from Breakfast Television and the hotel as described above. Distance between the Finalist’s place of residence and Toronto will be measured and determined by Contest Sponsors in their sole discretion based on the distances published at http://www.mto.gov.on.ca/english/traveller/map/Triangle.pdf.

    The Contest Sponsors reserve the right to withdraw the Finalists’ Photo submitted on the Website in whole or in part, after it has been broadcast. The Contest Sponsors also reserve the right to modify, in whole or in part, the Photo , or to disqualify the Finalist if for any reason it was found that his/her entry does not comply with these Contest rules.

  7. PRIZE

    7.1 Grand Prize
    There will be one (1) grand prize available to be won consisting of a 2014 Toyota Corolla (Model: S CVT “B” Package) in Barcelona Red (Colour: 0323) with black interior; with an approximate retail value of $23,220 (the “Grand Prize”). The Grand Prize includes freight and PDI charges. Although not included in the approximate retail value noted above, the Grand Prize will include all applicable dealer fees and taxes (which may vary depending on the jurisdiction of the winner).

    Colour and other specifics of the Grand Prize will be at Contest Sponsor’s sole discretion. Manufacturer’s warranty applies to the Grand Prize. Upon notification, winner, or if winner does not have a valid driver’s license and evidence of insurance, winner’s designated agent with a valid driver’s license and insurance who accompanies the winner, will personally take delivery of the vehicle from Toyota dealership within Canada reasonably close to the winner's home as designated by Toyota within 3 months of being confirmed as a winner in accordance with these Rules. Grand Prize will not be released unless winner or winner’s designated agent first shows proof of having a valid driver’s license for the province/territory in which he/she resides and provides evidence of satisfactory insurance. The Grand Prize will not be released without the winner being present and adequately identified to the satisfaction of the Contest Sponsors. Grand Prize winner is solely responsible for all expenses that are not included in the Grand Prize description above, including, but not limited to: registration and license fees, insurance, additional accessories and all other costs associated with: (a) any upgrade or option package(s) he/she may request (and that may be permitted by Sponsors in their sole discretion); and/or (b) obtaining a valid driver’s license, license plates, registration, insurance and/or fuel; and/or © travelling to and from a Toyota dealership within Canada for the purpose of taking delivery of the Grand Prize.

    PRIZE MUST BE ACCEPTED AS AWARDED. THE PRIZE MAY NOT BE SOLD, TRANSFERRED AND IS NOT CONVERTIBLE TO CASH. NO CHANGE. CONTEST SPONSORS RESERVE THE RIGHT TO SUBSTITUTE THE PRIZE IN WHOLE OR IN PART IN THE EVENT THAT ANY COMPONENT OF THE PRIZE IS UNAVAILABLE

    7.2 Secondary Prize
    There is one (1) Secondary Prize to be won consisting of:

    • $2,500 cash for the 2nd place winner

    Tertiary Prize
    There is one (1) Tertiary Prize to be won consisting of:

    • $1,000 cash for the 3rd place winner

  8. ODDS OF WINNING The odds of becoming a Finalist depend on the number and calibre of eligible entries received during the Submission Period. The odds of a Finalist winning the Grand Prize are 1in3.
  9. AWARDING OF THE PRIZE

    Before being declared the winner of either the Grand Prize, the Secondary Prize, or Tertiary Prize, the Finalists must first correctly answer, without assistance of any kind, whether mechanical, electronic or otherwise, a time-limited mathematical skill-testing question to be administered at a mutually convenient time by telephone and complete and return to the Contest Sponsors (or their authorized agents) by the deadline specified in the documents a written declaration and release (the “Declaration and Release”), declaring that the entrant is eligible to win the prize in accordance with these Contest Rules and releasing the Contest Sponsors, and all of their respective directors, officers, owners, partners, shareholders, employees, agents, representatives, successors and assigns from any liability in connection with this Contest, or the use, misuse or possession of any prize related thereto. Prize will only be awarded to the verified winner.

  10. GENERAL CONDITIONS

  11. Entry forms are subject to verification by the Contest Sponsors. Any entry form which is incomplete, fraudulent, submitted late, showing a wrong email address or phone number or otherwise noncompliant shall be rejected and will not entitle the entrant to be entered in the Contest or to win a prize.
  12. The Contest Sponsors reserve the right to disqualify an entrant or to cancel one or several entries by an entrant who participates or tries to participate in this Contest by using methods that do not comply with these Contest rules or that are unfair to the other entrants (e.g. entries exceeding the authorized limit).
  13. Each winner releases and holds harmless the Contest Sponsors, their affiliates, their advertising and promotional agencies, the suppliers of prizes, products, services and material related to this Contest, and each of their respective employees, agents and representatives from any and all liability in connection with this Contest his/her participation therein and/or the awarding and use/misuse of the applicable prize.
  14. The Contest Sponsors, their affiliates, their advertising and promotional agencies, the suppliers of prizes, products, services and material related to this Contest, and each of their respective employees, agents and representatives, are not responsible or liable for any of the following that may limit or prevent any entrant’s participation in the Contest: malfunctioning of any computer component, software or communications line; loss or lack of a communications network; or any transmission that is faulty, incomplete, incomprehensible or erased by any computer or network. The Contest Sponsors, their affiliates, their advertising and promotional agencies, the suppliers of prizes, products, services and material related to this Contest, and each of their respective employees, agents and representatives are also not responsible or liable for any damages or loss that may be caused, directly or indirectly, in whole or in part, by the downloading of any Web page or software or by the transmission of any information related to participation in the Contest.
  15. The Contest Sponsors do not warrant that access to or use of the Contest website will be uninterrupted during the Contest Period or error-free.
  16. The Contest Sponsors reserve the right, at their sole discretion, to cancel, modify or suspend this Contest in whole or in part, or to terminate it, should human intervention or an event take place that could modify or affect the administration, security, impartiality or conducting of the Contest as provided in these Contest rules, subject to approval by the Régie des alcools, des courses et de jeux du Québec if necessary.
  17. In the event that the computer system cannot record all the Contest entries or scores during the Contest Period for whatever reason, or if participation in the Contest must be terminated in whole or in part before the end date of the Contest as provided in the Contest rules, the Contest Sponsors, at their sole discretion and without liability to any entrant or intended entrant, may proceed with the selection from among the entries duly registered or recorded during the Contest Period or, as the case may be, up to the date of the event terminating participation in the Contest.
  18. In no event shall the Contest Sponsors, their affiliates, their advertising and promotional agencies, the suppliers of prizes, products, services and material related to this Contest, and each of their respective employees, agents and representatives be required to award more prizes than those indicated in these Contest rules or to award a prize otherwise than in accordance with these Contest rules.
  19. Persons who enter or try to enter this Contest release the Contest Sponsors, their affiliates, their advertising and promotional agencies, the suppliers of prizes, products, services and material related to this Contest, and each of their respective employees, agents and representatives from any liability for damage they may incur as a result of their participation or their attempt to participate in the Contest.
  20. Each winner or potential winner authorizes the Contest Sponsors and their representatives to use his/her name, Photo, likeness, statement regarding the prize, place of residence and/or voice for publicity purposes, without any additional form of compensation and agrees to execute and return a more complete Release to this effect before being awarded a prize.
  21. Any decision by the Contest Sponsors or their representatives regarding this Contest is final and without appeal, subject to a ruling by the Régie des alcools, des courses et des jeux du Québec on any issue under its jurisdiction or any other authority having jurisdiction in any other province of Canada.
  22. For the purposes of these Contest rules, the entrant is the person whose personal information appears on the entry form. It is this person to whom the prize will be awarded if he/she is selected and declared a winner.
  23. For Quebec residents, any litigation respecting the conduct or organisation of a publicity Contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie for the purpose of helping the parties reach a settlement.
  24. No communication or correspondence related to this Contest shall be exchanged with entrants except as provided for in the Contest rules or at the Contest Sponsors initiative.
  25. Entrants’ personal information collected for the purposes of the Contest will be used only to administer the Contest. No commercial or other communications unrelated to the Contest will be sent to entrants, unless they have otherwise agreed to receive such communications. Please see Rogers’ Privacy Policy at www.rogers.com for information on their policies towards maintaining the privacy and security of user information.
  26. If a section of the Contest rules is declared or deemed illegal, unenforceable or invalid by a competent court, that section shall be considered invalid, but all unaffected sections will be applied within the limits of the law.
  27. Any attempt to deliberately damage the website of this Contest and/or any related site or to sabotage the legitimate course of this Contest constitutes a violation of civil and criminal laws. Should there be any threats of violations, the Contest Sponsors reserve the right to reject the entrant’s entries and obtain legal or equitable relief under the applicable laws.
  28. In case of any discrepancy between the French and English versions of these Contest rules, the English version shall prevail.
